JUSTICE VINOD KUMAR SINHA ORAL ORDER 22-12-2016 Heard learned counsel for the petitioner and the learned A.P.P. for the State.
The application is for grant of bail for the offence under Sections 399/402, 120 (B) of the Indian Penal Code. It has been submitted on behalf of the petitioner that the petitioner has no criminal antecedent and he is in custody for about 04 months and the persons, having similar allegation, have been granted bail by this Hon'ble Court.
Heard learned A.P.P. also, who has pointed out that from the possession of the petitioner, one country-made Pistol has been recovered along with the cartridges, whereas co-accused, Prince Mishra, has been granted bail, from whose possession a Mobile was recovered.

No.55058 of 2016 (2) dt.22-12-2016 2/2 In view of the facts as stated above as well as the fact that the petitioner has been arrested at the spot and a country-made Pistol has been recovered from the possession of the petitioner, I am not inclined to grant bail to the petitioner at this stage, however, the petitioner may make prayer for his release after framing the charges.
With the aforesaid observation, the application is disposed of.
