The petitioner apprehends his arrest in connection with Bagaha P.S. Case no. 60 of 2017, registered under Sections 420, 409, 467, 468 & 471 of the Indian Penal Code.

The accusation is that petitioner is working as ANM at Primary Health Centre, Bagha and her appointment letter was sent for verification to Civil Surgeon-cum-Chief Medical Officer, Saharsa, who informed through letter No. 62, dated 13.01.2017 that appointment letter of the petitioner had not been issued to his office. Learned counsel for the petitioner submits that, in fact, the petitioner was appointed as ANM at Saharsa in the year 1987 and from there she was transferred to different places and presently, she is posted at Primary Health Centre, Bagaha, but without any

No.21509 of 2017 (5) dt.06-09-2017 2/2 departmental enquiry through Annexure-2 vide memo No. 200, dated 11.07.2016, the salary of the petitioner and six others have been stopped till further order. Further submission is that Punam Prasad, whose salary has also been stopped along with the petitioner has already allowed pre-arrest bail by a co-ordinate Bench of this Court vide Criminal Miscellaneous No. 8952 of 2017 on 01.08.2017. Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of her arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the A.C.J.M-I, Bagaha, West Champaran in connection with Bagaha P.S. Case No. 60 of 2017, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
