2. The petitioner apprehends his arrest in a case registered for offence under Section 3 of R.P.(UP) Act for theft of 35 batteries from the railways installation.

3. Learned counsel for the petitioner submits that F.I.R. has been lodged against unknown and name of the petitioner transpired during course of investigation in the confessional statement of co-accused Bambam Kumar. He further submits that no incriminating article has been recovered either from the possession or from the house of this petitioner. Petitioner claims clean antecedent.

4. Learned A.P.P. for the State has opposed the bail petition.

5. Considering the aforesaid facts and circumstances, let the above named petitioner, in the event of arrest/surrender within a period of six weeks from today, be enlarged on bail on furnishing bail-bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Railway Judicial Magistrate, Barauni, District Begusarai in connection with Bachhwara R.P.F. P.S. Case No. 01 of 2024, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
