Mr.Sri Rajballabh Singh ====================================================== CORAM: HONOURABLE MR. JUSTICE MOHIT KUMAR SHAH ORAL ORDER 17-01-2019 Heard the learned counsel for the petitioners and the learned A.P.P. for the State.

The petitioners seek regular bail in connection with Malsalami P.S. Case No. 260 of 2018 registered for the offence punishable under Sections 304(B), 302, 328/34 of the Indian Penal Code.

The allegation in the present case is regarding the accused persons having killed the victim girl on account of nonfulfillment of the demand for dowry. The learned counsel for the petitioners submits that the petitioners are the mother-in-law and father-in-law of the victim lady and they have got nothing to do with the alleged incident and if at all anybody is responsible, it might be the

Patna High Court Cr.Misc. No.2055 of 2019(2) dt.17-01-2019 2/2 husband who is already in custody. The petitioners are stated to be having a clean antecedent and they are languishing in custody since 13.07.2018.

Having regard to the facts and circumstances of the case, the petitioners, above named, are directed to be released on regular bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand) each with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-IVth, Patna City, Patna in connection with Malsalami P.S. Case No. 260 of 2018. It is needless to state that the trial court may verify as to whether the husband of the victim lady is in custody or not before enlarging the petitioners on bail.
