Petitioners seek bail in a case registered under Sections 302,201/34 of the Indian Penal Code pending before the Addl Sessions Judge, VIII, Gaya under Sessions Trial No. 97 of 2018.
It is submitted by petitioners' counsel that the victim was residing alone as she had been abandoned by her husband. He submits that the petitioners who are relative of the in-laws of the victim have falsely been implicated in this case since agricultural dispute was pending between the parties since before.
This Court has considered the prayer of the
Patna High Court CR. MISC. No.76232 of 2018(3) dt.06-03-2019 2/2 petitioners earlier on 03.05.2018. On the basis of case diary it was observed that the witnesses have supported the allegation of assault against the petitioners. Victim had earlier lodged Bhadwar P.S. Case No. 02 of 2016 against the petitioners for the offences under Sections 341,323,325/34 on 22.02.2016. Considering the nature of allegations against the petitioners, this Court is not inclined to allow the petitioners' prayer for bail for the present.
The prayer is rejected.
