2. The petitioner is apprehending arrest in connection with Narpatganj P.S. Case No. 534 of 2024, dated 26.10.2024, lodged under Sections 191(2), 191(3), 190, 126(2), 115(2), 118(1), 118(2), 109, 76, 303(2) and 329(4) of the B.N.S., 2023.
3. As per the prosecution, FIR has been lodged against 21 named accused persons including the present petitioner alleging that the accused persons assaulted the informant's son by farsa due to which the informant's son injured.
4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. Counsel further submits that the injury report of the informant's son has been annexed as Annexure P/2, which makes it clear that the wound is lacerated in nature and caused by a hard and blunt substance. Counsel further submits that the injury report does not support the allegations. Counsel also submits that Annexure

No.22974 of 2025(2) dt.30-04-2025 2/2 P/3 is the counter case for the same date and place of occurrence, and upon a bare reading of the FIR, it transpires that a land dispute is ongoing between the parties, and both the petitioner's side and the informant's side are adjacent neighbors Counsel also submits that the criminal antecedents of the petitioner are clean.
5. Learned APP for the State opposes the prayer for bail of the petitioner.
6. As such, in the present facts and circumstances of this case, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the Trial Court within a period of 4 weeks from today, on furnishing bail bond of Rs.30,000/- (Rupees Thirty Thousand) as mentioned in Section 2(1)(d) of the BNSS, 2023 to the satisfaction of C.J.M., Araria, in connection with Narpatganj P.S. Case No. 534 of 2024, subject to the conditions as laid down U/s 482(2) of the BNSS, 2023.
