The petitioners seek bail in Agiaon (G) P.S. Case No. 93 of 2016, registered for the offences punishable under Sections 30A and 56 of the Bihar Excise Act, 2016.

The petitioners were going on a tractor but the same was intercepted and from the tractor 30 cartons containing Royal Stage foreign liquor were recovered.

Learned counsel for the petitioners submits that the petitioners were passengers in the tractor and the driver of the tractor fled away. The petitioners are not the owner of the tractor and they have no manner of concern with the seized articles. The petitioners are in jail since 10.10.2016 and the petitioners have already remained in jail for more than three months.

No.54515 of 2016 (2) dt.16-01-2017 2/2 Considering the facts aforesaid, the petitioners above named are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate VIIth, Bhojpur at Ara in Agiaon (G) P.S. Case No. 93 of 2016.
