The petitioner being the husband of the informant is apprehending arrest in a case registered for the offences punishable under Section 498A of the Indian Penal Code and 3/4 of the Dowry Prohibition Act.
The accusation is of torture for non-fulfillment of dowry demand.
The petitioner was granted provisional anticipatory bail vide order dated 09.01.2015 by a co-ordinate Bench of this Court when it was directed to deposit Rs.750/- per month in the Court below to be released in favour of the informant. Subsequently, on
Patna High Court Cr.Misc. No.771 of 2015 (8) dt.01-08-2016 2/3 willingness of both the parties, vide order dated 13.05.2015, the matter was referred to the Patna High Court, Mediation and Conciliation Centre, to explore the possibility of settlement. The report of the mediator, dated 01.07.2016, kept at 'Flag-D', suggests that both the parties decided to part ways on payment of one time settlement of Rs.1,70,000/- (Rupees One Lakh Seventy Thousand only). Both parties further agreed to withdraw all the cases filed against each other.
It is submitted by learned counsel for the petitioner that the petitioner has already paid the entire amount of Rs.1,70,000/-. The order dated 20.07.2016 reflects that none is appearing on behalf of opposite party no.2. Today, also none is appearing on behalf of opposite party no.2.
Considering the report of the mediator, compliance of the terms of agreement by the petitioner and continuous nonappearance of opposite party no.2, let the provisional anticipatory bail granted to the petitioner in connection with Mahila P.S. Case No.150/2014, pending in the Court of learned CJM, Arrah, is hereby confirmed.
It is made clear that the petitioner is not required to deposit Rs.750/- per month before the learned Court below as directed earlier vide order dated 09.01.2015 by a co-ordinate
Patna High Court Cr.Misc. No.771 of 2015 (8) dt.01-08-2016 3/3 Bench of this Court. Hence, the order dated 09.01.2015 is modified accordingly.
