Heard learned counsel for the petitioner and learned counsel for the State.

Petitioner apprehends his arrest in a case registered under Section 25(1-B)A/26/35 of the Arms Act. Allegation against petitioner is recovery of one country made loaded pistol with live cartridge, ATM card of SBI and Aadhar card from the tenanted room of the petitioner. It has been submitted on behalf of petitioner that he is innocent and has been falsely implicated in this case. Nothing was recovered from his conscious possession.

In the facts and circumstances, I am not inclined to

Patna High Court CR. MISC. No.26036 of 2020(2) dt.21-10-2020 2/2 grant privilege of pre-arrest bail to the petitioner. However, if petitioner surrenders and seeks regular bail then his prayer for regular bail shall be considered on its own merits without being prejudiced by this order. This application is, accordingly, dismissed.
