This application has been filed for grant of regular bail in connection with Sikti P.S. Case No. 129 of 2022, registered for the offence punishable under Sections 363/366A of the Indian Penal Code.

As per F.I.R., a minor girl was taken by the petitioner and other co-accused. The case has been registered under Section 363/366A of the Indian Penal Code. From the reading of the First Information Report, a prima facie case it appears that offence is made out under various provisions of POCSO Act. In view of the aforesaid fact, this Court is not inclined to grant bail to the petitioner.

Patna High Court CR. MISC. No.23452 of 2023(2) dt.22-05-2023 2/2 Accordingly, the prayer of bail of the petitioner is rejected herewith.

The Superintendent of Police, Araria will submit a report after taking suitable action against the Station House Officer, Sikti Police Station as to why case under POCSO Act was not registered. The report must reach this Court within two months.
