JUSTICE RAJIV ROY ORAL ORDER 30-06-2026 Learned counsel for the petitioner, Mr. Siya Ram Shahi prays for and is allowed to implead the District Panchayat Raj Officer, Darbhanga as respondent no. 7 in course of the day.
2. The present application has been preferred for the following relief(s):
(i) for issuance of an appropriate writ in quashing Memo No. 2460 dated 08.09.2025 issued by Circle Officer, Jale, District- Darbhanga whereby and where under he has recommended the land of the petitioner for construction of Panchayat Sarkar Bhawan contained in Annexure 4.
Patna High Court CWJC No.5042 of 2026(3) dt.30-06-2026 2/3 (ii) For issuance of an appropriate writ restraining the respondent not to construct the Panchayat Sarkar Bhawan over the land of the petitioner.
(iii) For issuance of any other relief/reliefs for which the petitioner is entitled under law as well as under facts.
3. Learned counsel for the petitioner submits that the land originally belonged to late Mahavir Prasad Singh and the petitioner's husband being the legal heir, a will was executed in his name. Subsequently, her husband, Manoranjan Prasad Singh executed sale deed in her favour and as a result, she came in possession of the land.
4. However, the contention is that the Circle Offier, Jale, Darbhanga has issued letter no. 2460 dated 01.09.2025 for construction of Panchayat Bhawan on the said land showing the land to be of the Parveshika High School.
5. Learned State Counsel submits that it is just a proposal and there is no such petition to show that the petitioner objected to the said proposal showing the land to be in her possession.
6. At this stage, learned counsel for the petitioner submits that a proper petition along with supporting documents shall be filed before the respondent no. 7, the District Panchayat

7. If such petition is filed in next four weeks, the same has to be taken to its logical conclusion after hearing all the stakeholders including the Education Department if the contention of the C.O., Jale, Darbhanga is correct that in the revenue record, the name of High School is running.
8. With the aforesaid observation, the writ petition is disposed of.
