Petitioner seeks bail in Brahampur P.S. Case No.48 of 2019 registered under Sections 414 and 34 of the IPC and under Sections 25(1-B)a, 26 and 35 of the Arms Act and under Section 30(a) of the Bihar Prohibition and Excise Act. The informant intercepted a vehicle bearing Registration No.BR-03P-9124 and apprehended Balwant Choubey, Sumant Choubey and Pawan Kumar Choubey, who were sitting inside the vehicle. Dharmendra Choubey, Ritesh Choubey @ Raju Choubey and others were also apprehended. 264 litres of liquor was recovered from the vehicle. Ritesh Choubey @ Raju Choubey disclosed the name of the petitioner. Learned counsel for the petitioner submits that Ritesh Choubey, Balwant Choubey and many other accused persons

Patna High Court CR. MISC. No.25869 of 2020(2) dt.13-10-2020 2/2 including Dharmendra Choubey have already been enlarged on bail. The name of the petitioner figured in the case in the disclosure made by Ritesh Choubey. The petitioner is in jail since 29.11.2019. The petitioner has got criminal antecedent but he remained in jail for about eleven months.

Having considered the facts aforesaid and the fact that the petitioner has already remained in jail for about eleven months, the petitioner named above is directed to be released on bail on furnishing bail bond of Rs.10,000/-(rupees ten thousand) with two sureties of like amount each to the satisfaction of learned Additional Sessions Judge II-cum-Special Judge (Excise), Buxar in connection with Brahampur P.S. Case No.48 of 2019.
