JUSTICE VINOD KUMAR SINHA ORAL ORDER 15-12-2016 Heard learned counsel for the petitioner and the learned counsel for the State.

The petitioner seeks bail in connection with Udwantnagar P.S. Case No. 259 of 2016 registered for the offences punishable under Sections 25(1-b)A and 26 of the Arms Act.

Allegation against the petitioner is that of recovery of one country-made pistol with two live cartridges. It has been submitted on behalf of the petitioner that although country-made pistol and two live cartridges were recovered from the petitioner. However witnesses of seizure list during course of investigation has stated that there signature were taken by the police at the police station. It has also been submitted

Patna High Court Cr.Misc. No.53926 of 2016 (2) dt.15-12-2016 2/2 that the petitioner is incarcerating in jail custody since 24.06.2016, having no criminal antecedent.

Learned A.P.P.

opposes the prayer of bail application.

Having heard both sides, considering the facts and circumstances of the case, let the petitioner be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhojpur, Ara in Udwantnagar P.S. Case No. 259 of 2016.
