The petitioner is in custody in connection with Sitamarhi P.S. Case No. 114 of 2019 for the offence under Sections 272, 273 of the Indian Penal Code and Section 30 (a) of Bihar Prohibition and Excise Act, 2016.

Learned counsel for the petitioner submits that the petitioner has no criminal antecedent. Learned counsel for the petitioner further submits that in the instant case total 133.560 liters of liquor was seized. Learned counsel for the petitioner next contended that nothing was recovered from the conscious possession of the petitioner or from his house. Learned counsel for the petitioner submits that petitioner has no concern with the seized liquor. He submits that petitioner is in custody since

Considering the fact that the petitioner has no criminal antecedent, the Court is inclined to enlarge the petitioner on bail. Let the petitioner named above, be released on bail on furnishing bail bonds of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Addl. Sessions Judge-II-Cum Special Judge, Excise, Act, Sitamarhi in connection with Sitamarhi P.S. Case No. 114 of 2019.
