Petitioner seeks bail in Sikraul P.S. Case No.100 of 2018 instituted for the offence under Section(s) 30(a), 41(1) of Bihar Prohibition and Excise Act, 2016.
Counsel for the petitioner submits that there is no recovery of any illicit liquor from conscious possession of the petitioner.
In the written report, it is alleged that informant got information that illicit liquor is being carried by Apache motorcycle. One white coloured Apache motorcycle is doing the work of liner. It is alleged that total 17.28 litres foreign liquor has been recovered from black coloured motorcycle. It is further alleged that 8.64 litres foreign liquor has been recovered from
Patna High Court Cr.Misc. No.75223 of 2018(3) dt.21-02-2019 2/2 possession of one Sunil Kumar.
Petitioner is in custody since 16.10.2018 having clean antecedents.
In the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Additional Sessions Judge II cum Special Judge, Excise, Buxar, in connection with Sikraul P.S.
