Chhotan Mahto S/o Fudi Mahto Resident of village- Baluaha, PSKhodawandpur, District- Begusarai ... ... Petitioner/s
Versus
The State of Bihar ... ... Opposite Party/s ====================================================== Appearance :
For the Petitioner/s :
Mr. Bhubneshwar Mahto, Advocate For the Opposite Party/s :
Mr. Ram Sumiran Rai, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE DR. ANSHUMAN ORAL ORDER 06-05-2025 Heard learned counsel for the petitioners and learned APP for the State.
2. The petitioners are apprehending arrest in connection with Khodawandpur P.S. Case No. 99 of 2024, dated 26.07.2024, lodged under Section 126(2), 115, 118(1), 117, 109, 303(2), 76, 352, 351(2), 3(5) of the Bharatiya Nyaya Sanhita, 2023.
3. As per the prosecution, FIR has been lodged against 10 named accused persons, including the present petitioners alleging that they assaulted the informant and her family members.
4. It transpires to this Court that counsel for the
Patna High Court CR. MISC. No.24110 of 2025(2) dt.06-05-2025 2/2 petitioners has suppressed 31⁄2 lines in the typed copy of the FIR and subsequently affixed his signature on the same, certifying it to be a true copy of the original. This reflects a careless and reluctant attitude on the part of the counsel for the petitioners, indicating that he is not serious about the case, and put his signature on record. The same mistake has been made in Cr. Misc. No. 24195 of 2025, wherein similar suppression has been made in the typed copy by counsel for the petitioners in both cases.
5. Hence, it is due to this reason, this Court is not inclined to grant anticipatory bail to the petitioners, as the petitioners' counsel has made suppression in this case which is apparent from the record.
6. Accordingly, the present bail application stands dismissed.
