JUSTICE VINOD KUMAR SINHA ORAL ORDER 03-07-2019 This is an application for grant of anticipatory bail in connection with Shastri Nagar P.S. Case No. 422 of 2018, disclosing offences under Sections 147, 341, 323, 504, 420, 120B of the Indian Penal Code.
Prosecution story as per written report is that his father has purchased a house and his father is traders and he is residing with his family and children in Odisa. It is also alleged that one Surender Prasad forcibly entered into the house of the informant and got the electric connection in his name by committing forgery, for which, Shastri Nagar P.S. Case No. 53 of 2016 and Shastri Nagar P.S. Case No. 577 of 2016 have been lodged and the accused persons have also assaulted, causing injury.
Submission of the learned counsel for the petitioner is
Patna High Court CR. MISC. No.25860 of 2019(4) dt.03-07-2019 2/2 that an eviction suit is pending with respect to that property by the informant to grab the same.
Heard learned A.P.P. also.
Having heard both sides, considering the above fact that the eviction suit is pending between the parties, let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned A.C.J.M.-IV, Patna, in connection with Shastri Nagar P.S. Case No. 422 of 2018, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure with further condition that he will cooperate with the disposal of the eviction suit, pending between the parties.
With the aforesaid observation, this application is allowed.
