2. The petitioner seeks bail in connection with Dinara PS Case No. 187 of 2020 dated 09-07-2020, instituted for the offence punishable under Section 366 A of the Indian Penal Code .

3. The prosecution case, in short, is that on 06-07-2020 at about 12 noon, the informant's minor daughter was abducted by the petitioner and co-accused, named in the FIR, while she was going to her grandfather's house, for the purpose of marriage, and she is yet to be recovered.

4. Learned counsel for the petitioner submits that the petitioner is innocent and he has been falsely implicated in the present case. It is further submitted that the victim was not

It is further submitted that the victim went with the petitioner, married him and gave birth to a child. She was never taken from the lawful custody of her guardian. The present case was lodged on 09-07-2020 against the petitioner and his family members. It is submitted that in September 2023, the dead body of the victim was recovered from an unknown place, and accordingly, Chainpur P.S. Case No. 307 of 2023 under Sections 302 and 201 of the Indian Penal Code was registered on 27-09-2023 against unknown persons. During the course of investigation, the petitioner and his family members were implicated in the said case. It is further submitted that the petitioner has already been granted bail in Chainpur P.S.

Case No. 307 of 2023 by a Co-ordinate Bench of this Hon'ble Court vide order dated 06-02-2025 passed in Cr. Misc. No. 7126 of 2024. It is further submitted that they resided together peacefully at Adhaura, Kaimur, for three years, and a child was born out of their wedlock. After the recovery of the victim's dead body, the petitioner was implicated in the case merely on the basis of suspicion. Lastly, it is submitted that apart from the present matter, one criminal case is pending against the petitioner, i.e., Chainpur P.S. Case No.

Patna High Court CR. MISC. No.23581 of 2025(2) dt.07-05-2025 3/3 has already been granted bail. The petitioner was arrested in connection with the said case on 31-10-2023 and was remanded in the present case on 20-02-2024. It is further submitted that the charge sheet has already been submitted in the present case.

5. Learned APP for the State has opposed the prayer for bail.

Having considered the facts and circumstances of the case and submissions of learned counsel for the parties, let the petitioner be released on bail upon furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned ADJ- VII-cum -Exclusive (POCSO) Court, Rohtas at Sasaram/concerned court in connection with Dinara PS Case No. 187 of 2020.

7. The application stands allowed.
