Petitioner is accused in connection with Khagaria Excise Case No. 40 C 3of 2015 registered under Section 40A of the Excise Act.

Learned counsel appearing on behalf of the petitioner submits that nothing has been recovered from the conscious possession of the petitioner. The present case is of the date prior to amendment in the Excise Act. Petitioner is in custody since 19.10.2016.

Having considered the facts and circumstances of the case, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two
