JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 08-08-2017 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. The petitioners are apprehending their arrest in Barhat P.S. Case No.57/16 registered for the offence under Sections 302 and 120(B_/34 of the I.P.C.

The allegation of the informant is that the marriage of his sister Chameli Devi was solemnized with Sahindra Das and she went to her matrimonial house where her husband and other in-laws were not liking her and her husband had illicit relationship with the wife of his elder brother. Due to that reason his sister always used to make protest. In the meantime she gave birth of a female child on account of which she was being more tortured and

Patna High Court Cr.Misc. No.20221 of 2017 (4) dt.08-08-2017 2/2 on 15.3.2016 the petitioners including other co-accused killed her by pouring kerosene oil on her body.

Learned counsel appearing on behalf of the petitioners submits that the petitioners are the mother-in-law and the father -in-law of the deceased. In fact, she sustained burn injury in course of cooking meal and while the husband and other in-laws tried to extinguish fire but the sister of the informant could not survive. The witnesses in paragraph 22 of the case diary have also stated that on hearing hulla they reached there and saw the petitioners and other in-laws extinguishing fire of the body of the deceased.

Considering the facts and circumstances of the case, let the petitioners, above named, in the event of their arrest or surrender before the court below within four weeks from today, be released on bail on furnishing bail bonds of Rs.10,000/-each with two sureties of the like amount each to the satisfaction of Sri N.K.Yadav, J.M.1st Class, Jamui, in BarhatP.S. Case No.57 of 2016 subject to the conditions as laid down under Section 438 (2) of Cr.P.C.
