2. The petitioner has prayed for bail in connection with G.R. No. 2130 of 2019 arising out of Chandradeep P.S. Case No. 89 of 2019 registered for the offence punishable under Sections 302, 201, 120B and 34 of the Indian Penal Code.

3. The case of the prosecution is that the informant received information on mobile phone by villagers that dead body of his son was found buried in the ground near Noni Bahiyaar. The informant also came to know that accused Manna Singh and others took his son with them on 26.07.2019 to village Bara Solapur and murdered his son.

Patna High Court CR. MISC. No.25344 of 2024(3) dt.24-03-2025 2/3 petitioner has submitted that petitioner is innocent and has committed no offence. He has been falsely implicated in this case. The name of this petitioner is not there in the F.I.R. His name has surfaced in the re-statement of the informant which was recorded one and half months after the occurrence and has stated that on 26.07.2019, mamera sala of his son Raju Singh has taken away his deceased son to Bara Solapur. He has further stated that he believes that the petitioner has also role in the murder of his son. Nothing except this has come against this petitioner. It has further been submitted by learned counsel for the petitioner that the main assailant Man Singh @ Manna Singh has been granted bail by a Co-ordinate Bench of this Court vide order dated 15.12.2021 in Cr. Misc. No. 43769 of 2021. A statement has been made in para 3 of the petition that petitioner has no criminal antecedent. He is languishing in judicial custody since 16.12.2023.

5. The application for bail is opposed by learned APP for the State and learned counsel for the informant.

6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail
