JUSTICE ASHUTOSH KUMAR ORAL ORDER 19-01-2022 Heard Mr. Rajani Kant Singh, learned counsel for the petitioner and Mr. Anil Prasad Singh, learned APP for the State. The petitioner seeks bail in anticipation of his arrest in connection with Excise Case No. 28 of 2021 instituted for the offence under Section 30(a) of the Bihar Prohibition and Excise Act.

Though 18 litres of liquor has been recovered from a house which is in joint possession of the petitioner, but considering the factum of recovery, I am not inclined to grant anticipatory bail to the petitioner, notwithstanding the fact that the petitioner does not have criminal antecedents. The prayer for anticipatory bail is rejected. However, if the petitioner surrenders before the Court

No.31008 of 2021(2) dt.19-01-2022 2/2 below and seeks bail, his application shall be considered on its own merits taking into account that the recovery is from a house which is in joint possession and that the petitioner does not have criminal antecedents and an order shall be passed without being prejudiced by the fact that the present anticipatory bail application on his behalf has not been entertained. The application stands dismissed.
