JUSTICE RAKESH KUMAR ORAL ORDER 06-12-2016 Heard Sri Girish Chandra Sharma , learned counsel for the petitioner and learned Additional Public Prosecutor. The petitioner, who is in custody only since 30.3.2016 in a case which was registered long back in the year 2008 for the offence under Section 304B and other allied Sections of the Indian Penal Code vide Chainpur P.S. Case No. 92 of 2008 has prayed for grant of bail.
It is not in dispute that petitioner is the husband of the deceased . Learned counsel for the petitioner submits that it was not a case of dowry death rather the deceased committed suicide. Besides hearing I have perused the materials available on record including the impugned order which suggests that petitioner was specifically named as F.I.R. named accused in the
Patna High Court Cr.Misc. No.42301 of 2016 (3) dt.06-12-2016 2/2 year 2008 itself. His anticipatory bail was rejected in the year 2010 and thereafter he is in custody only since 30.3.2016. Keeping in view the nature of accusation I do not find any ground to extend the privilege of bail.
The petition stands dismissed.
Learned court below may take appropriate steps for early disposal of the case.
