Heard the learned counsel for the petitioners and learned APP for the State.
The petitioners apprehend their arrest for the offences alleged under Sections 147, 148, 149, 341, 325, 448, 427, 323, 324, 308, 504 and 506 of the Indian Penal Code registered in connection with Fatehpur P.S.Case No. 215 of 2021.
Patna High Court CR. MISC. No.23068 of 2022(2) dt.11-10-2022 2/2 As per allegation, the accused persons including the petitioners entered into the house of the informant and they assaulted her husband and son. Her son suffered fracture injury in his hand.
It appears that the petitioners have been granted the benefit of Section 41(1) of the Cr.P.C., as such, they are directed to surrender in the court below and make a prayer for regular bail, which shall be disposed of on the day of its filing without being prejudiced by this order. The learned court below shall consider the fact that the petitioners are the persons of clean antecedent.
With these observations, the application stands disposed of.
Office shall ensure that all defects are removed by the petitioners within the stipulated time as provided hereinabove, failing which the matter shall be brought to the notice of this Court.
