JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 17-09-2016 Heard learned counsel for the petitioner, learned counsel for the State and learned counsel for the informant. The petitioner is in custody since 02.07.2016 in connection with Complaint Case No. 1537 C of 2015 in which cognizance has been taken for the offences punishable under Sections 419, 420, 467 and 120-B of the Indian Penal Code. It is contended by the learned counsel for the petitioner that the petitioner is being coerced to pay Rs.10,15,000/- to the complainant on the ground that he had introduced the complainant to one Munna Singh who presented

Patna High Court Cr.Misc. No.39615 of 2016 (2) dt.17-09-2016 2/2 himself to be one Brij Kishore Singh and took the aforesaid amount for executing the sale deed in respect of certain land. It is further contended that the petitioner had not taken any money from the complainant and the actual payment was made to the executant of the sale deed. The petitioner had simply identified the executant.

On the other hand, learned counsel for the informant has vehemently opposed the prayer for bail of the petitioner. He has submitted that the entire payment was made to the petitioner of the present case and it was he who had introduced the complainant to Munna Singh claiming him to be Braj Kishore Singh who owned and possessed about 5 katha, 16 dhur land at Mouza Bishambharpur.

Be that as it may, regard being had to the nature of the offence and the period undergone by the petitioner in custody, he is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand only) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Danapur in Complaint Case No. 1537 C of 2015.
