2. The petitioner seeks regular bail in connection with Ara Muffasil (Dhobha O.P.) P.S. Case No. 315 of 2023 registered for the offences punishable under Section 392 of the Indian Penal Code.
3. As per the prosecution case, it is alleged that three unknown persons, boarded on motorcycle, looted the bag of the informant and his colleague Amrendra Kumar while they were returning after collecting dues from customers of their bank.
4. Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case on the basis of the confessional statement of co-accused Sandeep Kumar and he has also been made accused in other five
Patna High Court CR. MISC. No.24616 of 2024(4) dt.06-09-2024 2/3 cases on the basis of the confessional statement of said coaccused. Nothing has been recovered from the person or possession of the petitioner. The petitioner is not FIR named accused and he was not arrested from the spot and except the confessional statement of co-accused Sandeep Kumar, there is no material against him. The charge-sheet has already been submitted in this case against the petitioner and there is no chance of tampering with the evidence. The similarly situated co-accused, namely, Mukesh Kumar and Chunnu Paswan have been granted regular bail by this Court vide orders dated 28.06.2024 and 23.01.2024 in Cr. Misc. No. 32636 of 2024 and Cr. Misc. No. 86365 of 2023, respectively. The petitioner is in custody since 30.08.2023 and he undertakes to co-operate in the investigation and the trial of the case.
5. Learned APP for the State has opposed the prayer for regular bail of the petitioner.

Considering the facts and circumstances of the case and the submissions of learned counsel for the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.- VII, Bhojpur, Ara / Concerned Trial Court in connection with
