The petitioner seeks bail in Kudhani P.S. Case No.393 of 2017 registered under Sections 353, 307, 436, 332, 333 and other Sections of the Indian Penal Code.

The S.H.O., Kudhani alleged that he got information that one Upendra Sahni nephew of Sanjay Sahni was stabbed by one Santosh Sahni and his supporters. On such information, the police went there but 70-80 men and women started pelting stones at the instigation of Santosh Sahni. Rita Devi and Asha Devi sprinkled Kerosene oil on the vehicle of the police and Sanjay Sahni ignited fire.

The learned counsel for the petitioner submits that petitioner is of course named in the F.I.R. but no specific allegation is made against the petitioner. It is submitted that

Patna High Court Cr.Misc. No.73691 of 2018(2) dt.12-12-2018 2/2 petitioner has been named at the instance of his enemy. The police made specific allegation against Rita Devi and Asha Devi and Sanjay Sahni. Petitioner is in jail since 08.08.2018. Similarly situated 14 persons have already been granted anticipatory bail vide order passed in Cr. Misc. No.11283 of 2018 and Cr. Misc. No.21154 of 2018.

Considering the aforesaid facts, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M. 3rd (West)-cum-Sub Judge III, Muzaffarpur in connection with Kudhani P.S. Case No.393 of 2017.
