JUSTICE VINOD KUMAR SINHA ORAL ORDER 10-01-2017 Heard learned counsel for the petitioner as well as learned A.P.P. for the State.

The application is for grant of bail for the offence under Section 392 of the Indian Penal Code.

It has been submitted on behalf of petitioner that petitioner is not named in the F.I.R. and he is arrested on the basis of suspicion. It is alleged that one mobile has been recovered from the possession of petitioner and from F.I.R., it appears that informant's mobile is of SAMSUNG company whereas the recovered mobile is of INTEX company. It is further submitted that petitioner is languishing in judicial custody for about six months.

Patna High Court Cr.Misc. No.49188 of 2016 (3) dt.10-01-2017 2/2 Heard learned A.P.P. also. He could not raise any objection.

Having heard both sides. In view of the fact stated above, let the abovenamed petitioner be enlarged on bail on furnishing bail bond of Rs. 10,000/-(Rs. Ten thousand) with two sureties of the like amount each to the satisfaction of SubDivisional Judicial Magistrate, Araria in connection with Raniganj P.S. case no. 143 of 2016.
