====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 09-05-2024 Heard learned counsel for the petitioners and the State.
2. Petitioners apprehend arrest in a case registered for the offences punishable under Sections 341, 323, 324, 307, 379, 504, 506/34 of the Indian Penal Code and Section 27 of the Arms Act.
3. As per the prosecution case, these petitioners along with other F.I.R. named accused persons assaulted family members of the informant by means of farsa, iron rod.
4. Learned counsel for the petitioners submits that though there is allegation of assault against petitioner No. 1 but the doctor has found only one injury on the head of the injured
Patna High Court CR. MISC. No.24974 of 2024(2) dt.09-05-2024 2/2 which is caused by co-accused Sanjay Roy, as per the F.I.R. So far petitioner No. 2 is concerned, injury caused by him is found to be simple in nature. Police after investigation submitted final form against these petitioners. Case and counter case. He lastly submits that similarly situated co-accused, namely, Mukesh Rai, has already been granted anticipatory bail by this Hon'ble Court.

Considering the aforesaid facts and circumstances of the case, this anticipatory bail is allowed and it is ordered that let the above named petitioners in the event of their arrest/surrender before the court below within a period of six weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Sub-Divisional Judicial Magistrate, Udakishunganj in connection with Srinagar P. S. Case No. 63 of 2020, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure. (Prabhat Kumar Singh, J) Navya/- U T
