JUSTICE ANIL KUMAR SINHA ORAL ORDER 14-08-2019 The petitioner no. 1 apprehends his arrest in connection with Lalganj P.S.Case No. 326 of 2018 registered under Sections 307, 315, 323, 379 and 452/34 of the Indian Penal Code .

Allegation against the petitioner no. 1 is that he assaulted on stomach of informant by leg while she was having pregnancy of about 08 months resultantly causing bleeding to the informant.

It appears that vide order dated 17.07.2019, anticipatory bail application of petitioner no. 2 was allowed by this Court and for petitioner no. 1, supplementary injury report was called for. Supplementary injury report of the victim is on record

Patna High Court CR. MISC. No.23758 of 2019(5) dt.14-08-2019 2/2 which is at Flag-X to this application and from perusal of the same, it appears that ultra sonographic report of the victim has not been received and the doctor appears to have opined the injury as simple in nature.

After having heard learned counsel for the parties and taking into consideration the fact that in supplementary injury report, injury found by the doctor to be simple in nature as such I am inclined to grant anticipatory bail to the petitioner no. 1. Let the petitioner no. 1, abovenamed, in the event of arrest or surrender before the court below within a period of four weeks from the date of receipt of a copy of this order, be released on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of the learned CJM, Vaishali at Hajipur in connection with Lalganj P.S.Case No. 326 of 2018; subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
