JUSTICE MOHIT KUMAR SHAH ORAL ORDER 30-06-2022 Though the present writ petition has been filed for quashing the notice dated 25.1.2020, issued by the Circle Officer, Harsiddhi, East Champaran in Encroachment Case No. 42/2019-20, however, the petitioner has limited his prayer to issuance of a direction to the Circle Officer, Harsiddhi, East Champaran, to dispose of the Encroachment Case No. 42/2019-20 by passing appropriate orders under Section 6(1) of the Bihar

Patna High Court CWJC No.6285 of 2022(2) dt.30-06-2022 2/2 Public Land Encroachment Act, 1956, after considering the show cause reply along with the documents filed by the petitioner and granting him an opportunity of hearing.

Having regard to the limited prayer made by the petitioner, the present writ petition stands disposed of with a direction to the Circle Officer, Harsiddhi, East Champaran to pass final orders in the pending Encroachment Case No. 42/2019-20, after considering the show cause reply along with the documents filed by the petitioner and after giving an opportunity of hearing to the petitioner herein.

It is needless to state that till the final order is passed in the aforesaid encroachment case, status quo, existing as on today, shall be maintained.
