The petitioner seeks bail in a case initially registered under Section 394 of the Indian Penal Code and later on, Section-411 of the Indian Penal Code was also added. The prosecution case, in short, is that while informant was going with Amit Kumar having cash Rs. 10,000/-, in the way, the miscreants snatched a bundle of Rs. 50/- and also assaulted him.

It has been submitted on behalf of the petitioner that there is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is in custody since 29-09-2018. Charge sheet in this case has already been submitted. The petitioner has been made accused in this case due to previous

Patna High Court CR. MISC. No.20347 of 2019(2) dt.12-04-2019 2/2 enmity. 1450/- Rs. is alleged to have been recovered from possession of the petitioner. The same has not been put on TIP. It has further been submitted that the petitioner may be released after completion of nine months in custody.

On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, it is directed that after completion of nine months in custody, the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhagalpur in connection with Ishakchak P.S. Case No. 193 of 2018.
