JUSTICE SANDEEP KUMAR ORAL ORDER 17-05-2023 Heard learned counsel for the petitioner and learned Additional Public Prosecutor appearing on behalf of the State. The petitioner seeks regular bail in connection with Patahi P.S. Case No. 54/2023, registered for the offence punishable under Sections 363, 366(A)/34 of the Indian Penal Code and section 8 of the POCSO Act.

Learned counsel for the petitioner submits that the petitioner is innocent and falsely been implicated in this case. In view of the statement under Section 164 Cr.P.C. in which it has come that alleged victim has gone out of her own sweet will. Petitioner is in custody since 17.02.2023. Learned APP has vehemently opposed the prayer for bail.
