JUSTICE VINOD KUMAR SINHA ORAL ORDER 08-05-2019 Petitioner seeks bail in anticipation of his arrest in connection with Magadh University P.S. Case No. 117 of 2018 registered for the offences punishable under Sections 498A of the Indian Penal Code and Sections 3/4 of Dowry Prohibition Act.
Allegation against the petitioner is of demanding of Rs.5 lac and also of assaulting the informant. Submission of learned counsel for the petitioner is that he is still ready to keep the informant with him. However, learned counsel for the informant has submitted that she is not ready to reside with the petitioner as she was subjected to assault.
Heard learned APP also.
In view of above facts and circumstances, let
Patna High Court CR. MISC. No.20759 of 2019(2) dt.08-05-2019 2/2 petitioner surrender before the court below within a period of six weeks from the receipt of this order and on surrender he shall be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-IX, Gaya, in connection with Magadh University P.S.Case No. 117 of 2018, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and further condition is that one of the bailors of the petitioner shall be a local person having sufficient immoveable property within the jurisdiction of the court concerned.
Learned court below is directed to refer the matter to the Mediation Centre in which both the parties will appear and the Mediation Centre shall try to settle the matter amicably between the parties. It is needless to say that both the parties have to co-operate in the mediation.
