====================================================== CORAM: HONOURABLE MR. JUSTICE SUNIL DUTTA MISHRA ORAL ORDER 08-07-2026 Heard learned counsel for the petitioners and learned A.P.P. for the State.

2. The petitioners apprehend their arrest in a case registered under Sections 341, 323, 307, 379, 504, 506, 34 of the Indian Penal Code and Section 27 of the Arms Act.

3. As per prosecution case, on the alleged date of occurrence, the informant's maternal cousin, namely, Saddam was called up by Prince (petitioner no. 2) at the rack point where Saddam was assaulted by him. On the next day when the informant went to settle the dispute between them, at the instigation of other co-accused Md. Ishaque, Prince (petitioner no. 2) resorted to air firing causing injury to the upper portion of

Patna High Court CR. MISC. No.22369 of 2026(4) dt.08-07-2026 2/3 right eye of the informant. It is further alleged that the accused persons snatched chain and cash from the informant.

4. Learned counsel for the petitioners submits that petitioners are innocent and have falsely been implicated in this case. Injury to the injured are simple in nature caused by hard and blunt substance/pointed object. Informant's allegation of assault by lathi and danda is on co-accused Md. Samsad, and the injury report does not support the allegation of assault by the petitioners. Learned counsel for the petitioners further submits that other three accused persons including Md. Samsad, have already been granted anticipatory bail by a Co-ordinate Bench of this Court vide order dated 01.12.2025 in Cr. Misc. No. 78624 of 2025. Petitioners are young boys aged about 22 years and 23 years respectively, and they are students, having no criminal antecedent. There is no chance of absconding of petitioners or tampering with the evidence. They undertake to cooperate in the investigation and trial.

5. Learned A.P.P. appearing on behalf of the State opposed the bail application.

6. Having considered the facts and circumstances of the case, submissions of learned counsel for the parties, nature of allegation, age and clean antecedent of the petitioners,

No.22369 of 2026(4) dt.08-07-2026 3/3 who are students, let the above named petitioners be released on bail, in the event of arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned concerned Court, Saharsa in connection with Saharsa Sadar P.S. Case No. 539 of 2024 subject to the conditions as laid down under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita.
