JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 2 14-10-2015 Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner seeks pre-arrest bail in connection with Sono P.S. Case No. 68 of 2015 registered under Sections 341, 323, 504 & 354 read with 34 of the Indian Penal Code. According to the prosecution case, the petitioner, being drunk, outraged the modesty of the daughter-in-law of the informant.

It is contended that the petitioner is a co-villager of the informant and there is no truth behind the allegation made in the FIR.

Patna High Court Cr.Misc. No.44679 of 2015 (2) dt.14-10-2015 2 / 2 Learned counsel for the State has opposed the prayer for grant of anticipatory bail to the petitioner. He has submitted that there is specific allegation against the petitioner in the FIR which has been supported by witnesses during investigation of the case.

Be that as it may, regard being had to the facts and circumstances of the case, I am not inclined to grant anticipatory bail to the petitioner. Accordingly, the application is rejected. In case the petitioner surrenders and seeks bail, the same shall be considered on its own merit without being prejudiced in any manner by this order.
