JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 08-06-2017 Heard learned counsel for the petitioner and the State. The petitioner is apprehending his arrest in connection with Bhabua P.S. Case No. 323 of 2016 for the offence under sections 147, 148, 149, 323, 325, 326 and 307 of the Indian Penal Code.
From the FIR, it appears that the name of the petitioner does not figure in the FIR. However the petitioner has stated in para-5 that police visited several times in his house to arrest him and as such he has apprehension of arrest. It appears from the order contained in Annexure-2 series that the person even named in the FIR have been granted anticipatory bail considering the general and omnibus allegation. Reference to be made to the order passed by this court in Cr. Misc. No. 8909 of 2017 vide order dated 28.2.2017 whereby Chandan @
Patna High Court Cr.Misc. No.20401 of 2017 (2) dt.08-06-2017 2/2 Chandan Kumar was granted anticipatory bail and on the same ground other co-accused Md. Nazir Riyaz Ansari @ Golden Ansari was granted bail vide order dated 18.3.2017 in Cr. Misc. No. 12890 of 2017.
In view of the matter referred above and the fact that the petitioner has no criminal antecedent as stated on affidavit in para-3, let the petitioner, named above, be released on bail in the event of arrest or surrender before the court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Bhabua, in connection with Bhabua P.S. Case No. 323 of 2016 (Gr. No. 1262 of 2016), subject to the condition as laid down under section 438(2) of the Cr.P.C.
