Petitioner seeks bail in connection with Sessions Trial No.137 of 2017, arising out of Kumarkhand (Belari O.P.) Police Station Case No.37 of 2017, registered for the offences punishable under Sections 302, 201/34 of the Indian Penal Code pending in the court of learned F.T.C.-II, Madhepura. The report of the learned trial judge would reveal that only two witnesses, including the Doctor are yet to be examined on behalf of the prosecution.
The Superintendent of Police, Madhepura is directed to ensure the appearance of all those witnesses before the trial court in connection with Kumarkhand (Belari O.P.) Police Station Case No.37 of 2017, corresponding to Sessions
Patna High Court CR. MISC. No.72302 of 2018(4) dt.13-03-2019 2/2 Trial No.137 of 2017.
Earlier this Court had refused the prayer for regular bail to the petitioner on 17.01.2018 in Criminal Miscellaneous No.49114 of 2017, considering the allegation that petitioner committed murder of his two wives, which was supported by the villagers.
I am not inclined to enlarge the petitioner, above named, on bail for the present. Let trial be concluded expeditiously, preferably within four months. Let a copy of this order be sent to the Superintendent of Police, Madhepura.
