JUSTICE DINESH KUMAR SINGH ORAL ORDER 13-01-2015 At the outset, it is submitted that petitioner nos. 1,3 and 4 have already been arrested, hence, this application has become infructuous so far as it relates to petitioner nos. 1,3 and 4. Heard learned counsels for the petitioner and the State. The petitioner no. 2 is apprehending arrest in a case registered for the offences punishable under Sections 341,323 and 436/34 of the Indian Penal Code.
Petitioner no. 2 is the daughter in law of the informant. In the background of partition dispute, the wife, son, daughter in law and grand son came variously armed when the wife and the son of the informant were assaulted. Accused persons also put the house on fire.
It is submitted by learned counsel for the petitioners that
Patna High Court Cr.Misc. No.1249 of 2015 (2) dt.13-01-2015 2/2 accusation of making assault is not against the petitioners and the accusation of litting fire is omnibus and general. There is counter version of the occurrence also.
Considering the aforesaid facts, let the above named petitioner no. 2 be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned SDJM, Masaurhi in connection with Masaurhi P.S. Case No. 213 of 2014 subject to the conditions as laid down under Section 438(2) Cr.P.C.
