JUSTICE SATYAVRAT VERMA ORAL ORDER 06-05-2022 Heard learned counsel for the petitioner and learned A.P.P. for the State through virtual Court proceedings. The petitioner seeks bail in a case registered for the offences punishable under Sections 272, 273 and 34 of the Indian Penal Code read with Sections 30(a) and 41(i) of the Bihar Excise Act.

Learned counsel for the petitioner submits that the petitioner is in custody since 02.01.2022, charge-sheet has been submitted in the case and has antecedent of one case. Allegation is of recovery of one litre of liquor from the hut of the petitioner apart from recovery of liquor from other named co-accused persons.

Learned counsel for the petitioner submits that the petitioner was not arrested from the spot and he came to be

Considering the fact that the petitioner is in custody since 02.01.2022, charge-sheet has been submitted in the case, and in the nature of allegations, let the petitioner above named be released on bail on furnishing bail bond of Rs. 200/- (Rupees Two Hundred) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Sahebganj P.S. Case No. 445 of 2019.
