JUSTICE DINESH KUMAR SINGH ORAL ORDER 16-09-2015 Heard learned counsels for the petitioners and the State. The petitioners being the parents, brother and unmarried sister of the husband of the victim are apprehending arrest in a case registered for the offences punishable under Sections 498A, 306 and 504 of the Indian Penal Code and Section 3/4 of the Dowry Prohibition Act.

The prosecution case is that the daughter of the informant after one year of the marriage while she was pregnant, committed suicide due to torture inflicted by the in-laws family including the petitioners for non-fulfillment of the dowry demand. It is submitted by learned counsel for the petitioner that the victim committed suicide by jumping in front of running train and the informant has subsequently retracted from his initial

Patna High Court Cr.Misc. No.44084 of 2015 (2) dt.16-09-2015 2/2 version and filed a petition to that effect before the learned court below. The accusation is omnibus and general against the entire in-laws family.

Considering the aforesaid facts, let the above named petitioners be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned C.J.M., Bhagalpur in connection with Jagdishpur P.S. Case No. 120 of 2015, subject to the conditions as laid down under Section 438(2) Cr.P.C.
