Heard the parties.

The petitioners are languishing in custody for the offence punishable under Sections 328/302/34 of the Indian Penal Code.

Submission is that the F.I.R. was lodged on recovery of dead body of the son of the informant hanging with a tree. The prosecution case is that the son of the informant along with others had gone to take wine and poison was administered to him. Thereafter his dead body was recovered. Considering lack of direct material against the

No.30791 of 2021(2) dt.25-10-2021 2/2 petitioners and completion of investigation, let the petitioners, who are in custody since 10.02.2021, be released on bail on furnishing bail bond of Rs.20000/- (Twenty thousand) each with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Khodawandpur P.S. Case No. 255 of 2020, with following conditions:

(a) Both the bailors shall be the resident of territorial jurisdiction of the learned Court-below.

(b) The petitioners shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioners.

(c) The petitioners shall not leave the country without permission of the trial Court.
