The petitioner apprehends his arrest in connection with a case registered for the offences punishable under Sections 467/468/406/409/419/420/120(B)/471/472 of the Indian Penal Code.
Diary in the present case was called for, which has since been received.
Learned counsel for the petitioner submits that the petitioner is neither named in the FIR nor has he any connection with the alleged transaction of money. It is further submitted that money belonging to the State Exchequer which was to have been utilized by the Block Office at N.I.C. Bank Ltd., Alam Nagar. It was alleged that one senior Assistant Deepak Kumar Sinha by using

No.18230 of 2013 (4) dt.25-04-2016 2/3 the password of the account of the B.D.O., Alam Nagar bearing Account No. 11755507044 and 31817609549 were hacked and an amount of Rs.41 lacs and also the account in the N.I.C. Bank Limited (LTR Account No. 11458532091, to the tune of 13 lacs was hacked and deposited in the account of other customers, namely, Pawan Kumar Gaour, Ajay Runiyar, Dhirendra Kumar Singh, Pampa Devi, Sandeep Kumar, Nilam Devi, Indushekhar Singh and Basanti Devi. The said persons were in conspiracy with the aforementioned persons for withdrawal of the aforementioned amounts.
So far as the present petitioner is concerned, he is not named in the First Information Report. The name of the petitioner surfaced on account of the fact that the said Sandeep Kumar, named above, has stated the name of the petitioner that he had asked the said Sandeep Kumar to give his account number so that the petitioner could take the benefit of rupees one lac so transferred from the aforementioned banks. In view of such allegation made by Sandeep Kumar, the petitioner is facing prosecution.
Learned counsel for the petitioner submits that the petitioner and Sandeep Kumar are agents and have been on litigating terms and it is for the said reason that only to shrug off

There is no C.C.T.V. coverage or any other mode or any further cogent material available in the case diary so as to point fingers on the present petitioner. Learned counsel appearing on behalf of the State after perusal of the case diary submits that save and except the aforementioned allegation mentioned by the Sandeep Kumar, there is no further material in the case diary to substantiate the case against the petitioner.
Considering the aforementioned facts and circumstances and that the petitioner has no criminal antecedent, let the petitioner, in the event of his arrest / surrender within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Araria in connection with Jogbani P.S. Case No. 22 of 2012, subject to the conditions as laid down under Section 438(2) of the Cr. P.C. (Anjana Mishra, J) Saif/- U T
