The petitioner seeks bail in connection with Madhepura P.S. Case No. 759 of 2018, registered under Section 30(a) of the Bihar Prohibition of Excise Act. The accusation is that on seeing the Police personnel, one person who was present in the vehicle started fleeing, but he was apprehended by the Police, who disclosed his name as Bechan Yadav (Petitioner). On search, 144 bottle, each containing 375 ML India made foreign liquor was recovered from the said vehicle.
Learned counsel for the petitioner submits that, in fact, petitioner being pedestrian was moving on the road, in the meantime, Police came and gave signal to stop the said
Patna High Court Cr.Misc. No.71232 of 2018(2) dt.03-12-2018 2/2 vehicle, but driver of the vehicle succeeded to flee away and petitioner has been implicated in this case with false allegation. The petitioner has no criminal antecedent and he is in custody since 19.09.2018.
Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Addl. Sessions Judge-II-cum-Special Judge, Madhepura in connection with Madhepura P.S. Case No. 759 of 2018.
