JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 29-09-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is named in the first information report but according to the prosecution case itself, it was co-accused Chhathu Seth, who opened fire on deceased as a result thereof deceased died. The said Chhathu Seth was put on trial in Sessions trial no.629 of 2015 and, subsequently, was acquitted by the trial court vide judgment dated 18.04.2016.
No doubt, the evidence recorded in the Sessions trial no. 629 of 2015 shall not be read in respect of the petitioner but taking into consideration the above stated facts and circumstances of the case, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Sub-Divisional Judicial
