JUSTICE SANJAY PRIYA ORAL ORDER 25-04-2017 Heard learned counsel for the petitioners and the State. Counsel for the informant appeared and opposed the prayer. The petitioners apprehend their arrest in Madhepura P.S. Case No. 27 of 2017 initiated for the offence under Sections307/34 of the Indian Penal Code and 27 of the Arms Act. As per fardbyan, these petitioners fired from their gun on account of land dispute. In course of firing, the informant sustained fire-arm injury in his left leg. The learned Sessions Judge has mentioned in impugned order that the doctor has found bullet injury in left leg have entry wound 3x1 c.m. From back of leg around 15 c.m. above the ankle joint and exit wound 1x1 c.m. show laceration but the bullet changed his path and fresh in tibia bone and X-ray shows that the bullet was in tact.

Patna High Court Cr.Misc. No.15027 of 2017 (2) dt.25-04-2017 2/2 In such circumstances, after looking into nature of firearm injury sustained by informant,this court is not inclined to grant anticipatory bail to the petitioners. Accordingly, prayer for anticipatory bail stands rejected.

The petitioners are directed to surrender before the court below and seek regular bail, which shall be considered and disposed off on its own merit without being prejudiced by this order.
