JUSTICE DINESH KUMAR SINGH ORAL ORDER 07-01-2015 Heard learned counsels for the petitioner and the State. The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 341, 323, 326A and 504/34 of the Indian Penal Code.
The accusation against petitioner no.1, Ganga Sagar Mahto is to have poured acid on the body of Ramdeo Mahto causing burnt injury to him.
It is submitted by learned counsel for the petitioners that no overt act has been alleged against petitioner nos. 2 and 3. There is counter version of the occurrence also where similar is the accusation of pouring acid against the informant's side. A statement has been made in para 3 of the petition that the petitioners have no criminal antecedent.
Considering the aforesaid facts, let the above named
Patna High Court Cr.Misc. No.188 of 2015 (2) dt.07-01-2015 petitioner nos. 2 and 3 be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned J.M., 1st Class, Begusarai in connection with Khodabandpur P.S. Case No. 83 of 2014, subject to the conditions as laid down under Section 438(2) Cr.P.C. This Court is not inclined to grant anticipatory bail to petitioner no.1.
Let the learned court below consider the regular bail of the petitioner no.1 without being prejudiced by the order of this Court if he surrenders within a period of six weeks. (Dinesh Kumar Singh, J) Amrendra/- U T
