2. The petitioner is apprehending arrest in connection with Alauli P.S. Case No. 15 of 2025 lodged on 13.01.2025, for the offence punishable under Sections 191(2), 191(3), 190, 329(4), 127(2), 115(2), 109, 76, 303(2), 352, 351(3) of the Bharatiya Nyaya Sanhita, 2023.
3. As per the prosecution, FIR has been lodged against 7 named accused persons including the present petitioner. The allegation against the petitioner is that he has assaulted the informant on his head by kudal, due to which he sustained injury and subsequently, petitioner also assaulted the informant's wife and mother by lathi danda and other accused persons have also assaulted the informant's father due to which

4. Learned Counsel for the petitioner submits that the petitioner is innocent and has committed no offence. Counsel submits that the allegation made in the FIR is absolutely false and cause of dispute has been stated in the FIR itself that there is land dispute going on between the parties. Counsel submits that petitioner and informant are neighbour and well known to each other and none of the parties are criminal. Counsel further submits that the criminal antecedent of the petitioner is clean. Counsel submits that there is case and counter case i.e. one case has been lodged from the petitioner's side bearing Alauli P.S. Case No. 14 of 2025 and the present case has been lodged from the informant's side bearing Alauli P.S. Case No. 15 of 2025.
5. Learned APP for the State opposes the prayer for bail of the petitioner and submits that there is case and counter case. Counsel further submits that there is specific allegation against the petitioner of assault upon the informant's mother and wife in the FIR.
6. As such, in the present facts and circumstances of this case, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the

No.23587 of 2025(2) dt.30-04-2025 3/3 Trial Court within a period of 4 weeks from today, on furnishing bail bond of Rs.30,000/- (Rupees Thirty Thousand) as mentioned in Section 2(1)(d) of the Bharatiya Nagarik Suraksha Sanhita, 2023 to the satisfaction of Chief Judicial Magistrate, Khagaria, in connection with Alauli P.S. Case No. 15 of 2025, subject to the conditions as laid down U/s 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.
