In this case, the petitioner no.1 is seeking bail in connection with Banka P.S. Case No. 704 of 2016 registered for offences under sections 47A, 47D, 47E & 53(C) of the Bihar Excise (Amendment) Act, 2016.
It is pertinent to mention herein that vide order dated 24.10.2016 passed in this case itself, the petitioner no.2, namely, Panchu Mandal has already been granted bail by this Court. As per allegation, 5 liters of country made wine and 9 Kg. of Mahua have been recovered from the possession of the petitioner no.1. The petitioner no.1 is languishing in judicial custody since 24.8.2016.
Patna High Court Cr.Misc. No.46360 of 2016 (3) dt.16-11-2016 Looking to the period of custody and the entire facts and circumstances of the case, let the petitioner no.1, namely, Chandar Tuddu, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Banka in connection with Banka P.S.
