In this case, the petitioners are apprehending their arrest in connection with Kishanpur P.S. Case No. 166 of 2016 registered for offences under sections 147, 148, 149, 341, 323, 324, 307, 379, 504 and 506 of the Indian Penal Code. As per First Information Report, the village road was under construction, the villages requested removal of the coconut tree which led to assault from both sides. An allegation has been made against petitioner no.2, Laxman Kamat to have caused injury by Axe whereas allegation has been made against petitioner no.1, Jeebachh Kamat to have assaulted by Lathi.

Patna High Court Cr.Misc. No.20516 of 2017 (6) dt.13-09-2017 Looking to the entire facts and circumstances of the case, let the petitioner no.1, namely, Jeebachh Kamat, in the event of his arrest or surrender before the court below within a period of four weeks from today, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Supaul in connection with Kishanpur P.S. Case No. 166 of 2016, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. The prayer for anticipatory bail of the petitioner no.2, Laxman Kamat is rejected. If he surrenders before the court below within a period of three weeks from today and prays for bail, the court below will consider the same and will pass orders in accordance with law.
